TERMS OF SERVICE

By accessing or using the Elumnos platform ("Platform"), including its website, applications, and learning content, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

Elumnos ("we," "us," or "our") reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or in-platform notification. Continued use of the Platform following notification constitutes acceptance of the updated Terms.

You must be at least 18 years of age to register for and use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and that the information you provide during registration is accurate, complete, and current.

The Platform is intended for professional and educational use. Users who create accounts on behalf of organisations represent that they have authority to bind that organisation to these Terms.

To access the Platform, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must notify us immediately at legal@elumnos.com if you suspect unauthorised access to your account. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or whose credentials appear to have been compromised.

Subject to your compliance with these Terms, Elumnos grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial educational purposes.

All content on the Platform — including but not limited to text, graphics, video, audio, course materials, AI-generated feedback, and software — is owned by or licensed to Elumnos and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.

You retain ownership of content you submit to the Platform (such as notes). By submitting content, you grant Elumnos a worldwide, royalty-free licence to use, store, and process that content solely for the purpose of providing and improving the Platform.

You agree not to use the Platform to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of any third party
• Transmit any material that is unlawful, harmful, defamatory, or obscene
• Attempt to gain unauthorised access to any part of the Platform or its related systems
• Use automated tools to scrape, crawl, or extract content from the Platform
• Share your account credentials with any third party
• Use the Platform for commercial resale or redistribution of its content
• Misrepresent your identity or affiliation with any person or organisation

The Platform uses artificial intelligence, including large language models operated by Anthropic, PBC, to power features such as the AI Tutor, Guided Lesson, and Quick Recall tools. By using these features, you acknowledge that:

• AI-generated content may contain errors or inaccuracies and should not be relied upon as professional advice
• Your interactions with AI features may be processed by Anthropic subject to their privacy policy
• We do not guarantee the accuracy, completeness, or fitness for a particular purpose of AI-generated responses
• You should independently verify any information obtained through AI features before relying on it

Access to certain Platform features may require payment of a subscription fee. Subscription terms, pricing, and billing cycles will be presented to you at the point of purchase. All fees are stated inclusive of applicable taxes unless otherwise specified.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time via your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of subscription periods except where required by applicable law.

We reserve the right to change subscription pricing with at least 30 days' notice to registered users.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ELUMNOS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELUMNOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the twelve months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the Swedish courts for any disputes arising from or relating to these Terms or your use of the Platform.

Before initiating any formal dispute, you agree to contact us at legal@elumnos.com and attempt to resolve the matter informally for a period of 30 days.

You may terminate your account at any time by contacting us at legal@elumnos.com or through your account settings. We may terminate or suspend your access immediately, without prior notice, for conduct that we determine to violate these Terms, poses harm to the Platform, or for any other reason at our sole discretion.

Upon termination, your right to access the Platform ceases immediately. Sections 4, 6, 8, and 9 survive termination.
